Welcome to New York Iconic Cruises (or NY Iconic Tours). Please read our terms and conditions carefully, as they form the basis for all transactions with our company. These terms and conditions affect your legal rights. They contain provisions for mandatory arbitration and limit the remedies available in certain disputes.

By accessing or using our websites, mobile applications, or blogs (referred to as the “Sites”) provided by New York Iconic Cruises or ordering, receiving, or using any of our Services (such as sightseeing tours, bus rides, boat cruises, or tours) offered through the Sites, street ticket sellers, or third-party channels, you agree to be bound by these Terms and all the terms incorporated herein by reference, including our privacy policy. If you do not agree to these terms and conditions, you may not access or use the Sites or order, receive, or use our Products.

These terms and conditions do not alter any other agreements you may have with us regarding our products or services. If you are using the Sites on behalf of another person or entity, you represent and warrant that you are authorized to accept these Terms on their behalf and that they agree to be responsible if you or they violate these terms and conditions.

New York Iconic Cruises reserves the right to change or modify these terms and conditions at any time and in our sole discretion. We will provide notice of any changes through the Sites or by updating the “Revision Date” at the beginning of these Terms. By continuing to access or use the Sites or order, receive, or use our Products, you confirm your acceptance of the revised terms and conditions. We encourage you to review them frequently to ensure your understanding of the applicable terms. If you do not agree to the revised terms and conditions, you may not access or use the Sites or order, receive, or use the Products.

LIABILITY AND WARRANTIES

By accessing or using our websites, mobile applications, or ordering, receiving, or using any of our Services, you agree to the following:

  1. Voluntary Participation: You acknowledge that your participation in our Services is voluntary, and you assume all associated risks. You waive any rights, claims, or causes of action arising from your participation.
  2. Indemnification: You agree to indemnify and hold harmless New York Iconic Cruises from any claims, suits, or actions associated with you or anyone on your behalf. This includes legal fees and related costs arising from such actions.
  3. Release of Liability: You release and discharge New York Iconic Cruises, its directors, officers, employees, representatives, and agents from any liability for claims, including but not limited to negligence, physical injury, property damage, accidents, illnesses, and pain.
  4. Arbitration: Any dispute or claim arising from this liability and warranties disclaimer shall be settled through binding arbitration in accordance with the laws of New York State, before a single arbitrator of the American Arbitration Association (AAA). The arbitration process will be conducted under AAA regulations and rules.
  5. Individual Arbitration: Disputes will be resolved solely through individual arbitration, and not as a class arbitration or representative proceeding. Disputes cannot be brought as a class or other type of representative action, whether within or outside of arbitration.

By agreeing to these terms and conditions, you acknowledge that you have read and fully understand the liability and warranties disclaimer. You agree to release all liability to the greatest extent allowed by law.

TICKETS

  1. Ticket Responsibility: Customers are responsible for keeping their tickets safe. New York Iconic Cruises will not issue replacement tickets.
  2. Ticket Presentation: Customers must show or purchase their tickets as they board. Tickets remain the property of the company and must be produced for inspection upon demand.
  3. Valid Ticket Requirement: Customers must have a valid ticket for the entire journey. Traveling without a valid ticket will result in being charged the full ticket price for a replacement ticket.
  4. Ticket Duration: A ticket allows the Customer to use all New York Iconic Cruises services during operational hours for the ticket’s duration. Expired tickets require either leaving the tour or purchasing another ticket.
  5. Service Guarantee: A ticket does not guarantee travel on a specific service or at a specific time.
  6. Headphones: Passengers receive one set of headphones per ticket for the duration of the ticket.
  7. No Refunds: All sales are final. No refunds are provided for used or unused services, lost or stolen tickets. New York Iconic Cruises reserves the right to change or terminate any scheduled tour without responsibility for delays.

NO RESALE

You are prohibited from reselling or using the Products for commercial purposes.

CHILDREN

For sightseeing tours, bus rides, boat cruises, or tours (excluding special events), children under 4 years old ride for free when accompanied by an adult and do not occupy a separate seat. Child rates apply to children aged 4 through 12. For cruise events, all passengers, including children, need to purchase tickets for admission.

TOUR OPERATION

  1. Delay Responsibility: New York Iconic Cruises assumes no responsibility for delays in tour operations.
  2. Tour Departure: Tours depart only if a minimum of 20 passengers are present for each scheduled departure. If less than 20 passengers are present, the tour does not depart. Non-departed customers’ tickets are valid for the next available departure.
  3. Non-Departure Remedy: Customers unable to access tours due to non-departure may use the next available departure for the respective tour.
  4. Tour Changes and Terminations: New York Iconic Cruises reserves the right to change or terminate any scheduled tour due to weather, security, acts of nature, or other conditions beyond our control. Schedule changes will not be considered a cause for refund or claim.

DEPARTURE POINTS AND TIMES

Departure points and times provided for the service are as accurate as possible but may be subject to change without prior notice.

REFUNDS

All sales are final. No refunds are given for used or unused services, lost or stolen tickets, or disruptions or inability to attend, complete, or enjoy the service. Refunds will not be provided for various reasons, such as weather, traffic, schedule changes, audio issues, tickets purchased through third parties, or last-minute trip cancellations.

Refund requests must be made in writing within 7 days of the scheduled service. Requests should include a copy of the purchased ticket(s) and be emailed to contact@newyorkiconiccruises.com. Refunds are not guaranteed and may be subject to a 20% administrative fee at New York Iconic Cruises’ discretion.
